We continue to provide a full range of legal services but we will be making appointments for in-person meetings on essential matters only and are following all recommended social distancing measures. Canada Emergency Commercial Rent Assistance Program

The Government of Canada, through Canada Mortgage and Housing Corporation (“CMHC”), launched the Canada Emergency Commercial Rent Assistance ("CECRA") on May 25, 2020! This program is designed to provide relief to small business owners who rent commercial property and are experiencing financial hardship, due to COVID-19. The CECRA works by reducing the amount of rent payable by the eligible small business owner but also allows the eligible Property Owner to be paid 75% of the rent owing.
How does it work?
For the months of April, May, and June 2020:
  • Eligible Small Business Tenants will be responsible for 25% of the rent owed to the Property Owner;
  • Eligible Property Owners will forgive 25% of the rent owed by the Small Business Tenant (this amount will not be recoverable by the Property Owner); and
  • CMHC will loan the Property Owner the remaining 50% of the rent owed by the Small Business Tenant (interest free) and will forgive the Loan on December 31, 2020 so long as the Property Owner abides by the terms and conditions of the CECRA. Any defaults will result in the loan becoming due and payable by the Property Owner.
Property Owners are not required to have a mortgage in order to qualify for this program.
Applications are open until August 31, 2020 and will apply retroactively. Once the Application is approved, it applies to April, May, and June automatically. If rent has already been paid by the Small Business Tenant, the overage must either be reimbursed to the Small Business Tenant or applied to upcoming rent payments, at the Small Business Tenant’s election. The Property Owner cannot keep the overage.
